This website is operated by Cheeky Nibble Limited. Throughout the site, the terms “we”, “us” and “our” refer to Cheeky Nibble Limited. Cheeky Nibble Limited offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

Cheeky Nibble uses the shipping carriers Evri and DPD. Cheeky Nibbles use Evril for any packages 500g to 15kg, and DPD for over 10kg.

We aim to delivery within 2-5 workings days and will do our best to achieve this, but cannot accept liability to you in respect of any failure to deliver within this timescale. Furthermore, we cannot take responsibility for delays by EVRI and DPD which are outside of our control.

Once the customer has placed an order with Cheeky Nibble it is the customer’s responsibility to ensure they are in for these deliveries or that they update their delivery options through the tracking link Cheeky Nibble will provide via email once the order has shipped or through the additional tracking provided directly from the couriers. With an EVRI or DPD delivery details can be updated to send the package to a EVRI or DPD access point, safe place or neighbour if the customer is not going to be at the specified delivery address on the date of delivery.

Cheeky Nibble will not be held responsible for any parcels that are not collected in time due to the receiver not having updated their delivery options through the online tracking or not having collected their parcel in time from the EVRI or DPD access point.

If a parcel is returned to sender due to missed collections or no one being available for the delivery attempts, Cheeky Nibble incurs an extra returns cost from EVRI or DPD. If a redelivery is requested this will be at the customers expense.

Cheeky Nibble will also not be held responsible for incorrect email addresses provided at checkout, resulting in the tracking email for the order being sent to the wrong email address. A redelivery will be at the customers expense.

Cheeky Nibble will also not be held responsible for incorrect delivery details provided at checkout by the customer, resulting in the parcel being sent to the wrong address. A redelivery will be at the customers expense.

Missing items or undelivered items: As EVRl and DPD require 10 days post delivery of an order to investigate any loss or damage during transit, we require customers to let us know of any issues with their delivery within this timeframe, otherwise Cheeky Nibble will not hold responsibility for any damages or loss in relation to the delivery of the customers order.

For missing items within an order, a photo of the delivery as it arrived to you will be required, along with a photo of the shipping label. If this cannot be supplied you may be required to sign a missing items declaration to allow us to raise an investigation with the courier involved.

We have a 30-day return policy, which means you have 30 days after receiving your item to request a return. 

To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

Damages and issues 
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Exceptions / non-returnable items 
Certain types of items cannot be returned, like perishable goods (such as food, flowers, or plants), custom products (such as special orders or personalized items), and personal care goods (such as beauty products). We also do not accept returns for hazardous materials, flammable liquids, or gases. Please get in touch if you have questions or concerns about your specific item. Cheeky Nibble Granola if unopened and undamaged can be returned to sender for a full refund, please email contact@cheekynibble.com to arrange. 

Unfortunately, we cannot accept returns on sale items or gift cards.

Exchanges 
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

European Union 14 day cooling off period 
Notwithstanding the above, if the merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without a justification. As above, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

Refunds 
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too. 
If more than 15 business days have passed since we’ve approved your return, please contact us at contact@cheekynibble.com.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 7 working days.

Once your return has been agreed with us, to return your product, you should mail it to: Cheeky Nibble Limited, Building 78, Blenheim Way, West Raynham Business Park, NR21 7PL.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. Original shipping cost to receive the goods is also non-refundable.

When shipping the item back to us, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item and if we don’t receive it unfortunately we can’t offer the refund. In the event, we don’t receive the returned item proof of delivery is required.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Certain products or services may be available exclusively online through the website.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

In the event that your Cheeky Nibble order has not been received and the courier is stating it has been delivered. Please contact us via email at contact@cheekynibble.com. We will require a Non Receipt of Goods Declaration to be filled out and signed. Once we receive your documentation we will raise a dispute with the courier and send a replacement.

You may choose to subscribe to a subscription plan through the Service. The subscription plan to our Service consists of an initial charge followed by recurring monthly charges as agreed to by you. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature and that you accept responsibility for all recurring charges prior to cancellation.

We will submit monthly charges without further authorisation from you, until you opt out of auto-renewal on your account page by using the “Cancel Subscription” button. You are able to unsubscribe at any time before your subscription renews.

The initial payment for Cheeky Nibble will be withdrawn at the time of checkout. For subsequent renewal orders, payments are automatically scheduled to withdraw each month, based on sign up date.

Promotional codes/discounts (when available) are only valid on the initial order, not the recurring charges, unless otherwise noted.

We reserve the right at our absolute discretion not to renew your subscription at any time without giving any reasons for our decision.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase, delivery and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions, deliveries and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

Certain content, products and services available via our Service may include materials from third-parties.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. eGift Cards must be redeemed within one year of purchase. Once redeemed, they cannot be cancelled/refunded. You will not be eligible for a refund if not redeemed within the expiration date. You will not be able to extend the expiry date of the gift card.

If you cannot find the email with your eGift Card we would require proof of purchase in order to resend the eGift Card.

eGift Cards cannot be exchanged for monetary value.

For eGift Cards the only way to receive a refund is for the purchaser to request this via our Customer Care Team at contact@cheekynibble.com. Our normal returns and refund policy apply which can be found in SECTION 3 above.

It is the buyer’s responsibility to ensure they have ensured the correct email address of the recipient of the eGift Card, Cheeky Nibble will not be held responsible for incorrect email addresses entered. Cheeky Nibble will do all they can to help resolve the situation, and if the eGift Card hasn’t been redeemed yet we can cancel the order, refund the amount and a new eGift Card can be purchased and sent to the correct recipient.
